The real property hereinafter described is no longer required for the purposes of the District; and, Section 2. The City of Santa Ana, by means of letters dated December 6, and December 15, 1965, has requested that the District quitclaim to said City said real property for the purpose of obtain- ing future street easements; and, Section 3. The said real property and improvements thereto was valued at $5,000 per acre, more or less, at the time said real property was conveyed to District by the City of Santa Ana in Decem- ber, 1951; and, Section 4. The best interests of the District and the public will be served by reconveying said real property by the District to the City of Santa Ana for a consideration of $5,000 per acre; and, Section 5. Upon payment of the sum of $4,650 the Chairman and Secretary of County Sanitation District No. 1 are hereby author- ized and directed to execute and deliver to the City of Santa Ana a quitclaim deed to the real property described in Schedule "A" attached hereto. Parcel 1 as described in Schedule "A" comprises an area of 0.69 acres, more or less, and is hereby valued at the sum of $3,450. Followed by the counter-argument that the sewer had to be placed exactly where it ie because of the present .ise of the lam. ONE P/11aH aJJr11Sa r11pli11a io: . 217 North Main Street Phone : · 54 7-0511 The staff of the City of Santa Ana, and the staff of District ONE have met·.for the pur;ose of negotiating the sale to City of certain rights of way as authorized by the Board of Directors at their meet- ing of December 8, 1965. As a result of these negotiations, the City of Santa Ana offers to pay $4,650 for 0.93 acre of easements. This is based on a value of $5,000 per acre which is more than the value of land was in this area when the easements were transferred to the District by the City in 1951. This value is close to, and probably more than, the amount paid by the District if the assumption is made that the pipe has no value but considering land only. The parcel east of Greenville Street (on the Borchard property) is approximately 2,130 feet long and 14 feet wide with an area of 0.69 acre. At$5,000 per acre, its value is established as $3,450. This is Parcel 10, excepting Flood Control right of way, as shown on "Right of Way Map of City Outfall Sewer of the City of Santa Ana, 1950" • . ,, ·The parcel west of Greenville Street {on the Heffernan property) is approximately 750 feet long and 14 feet wide with an area of 0.24 acre. J~~ 0 0 · .. \\ \ •.\ \ \ ' -· ' _,,.:.._~ '-.:::,: I ./ ,, 12-15-65 FAH BACKGROUND INFORMATION ON THE ACQUISITION OF THE TUSTIN AVENUE SEWER FROM THE CITY OF SANTA ANA The 3.7 million dollar bond issue which was passed in the early part of 1962 provided, among other facilities, for the con- struction of a District sewer north on Tustin Avenue beginning at First Street, Santa Ana, to La Veta Street just southerly of Santiago Creek. At the time of the bond election Santa Ana had constructed a 1211 sewer in Tustin Avenue from First Street to Seventeenth Street. Later the City extended another existing sewer in Seventeenth Street north in old Tustin Road, and at the present time this sewer extends above Santa Clara in Tustin Avenue. .A couple of years ago the District's engineers were advised by the State Division of Highways that construction of the proposed Garden Grove Freeway across Tustin Avenue would prohibit the installation of a sewer to La Veta Avenue, in that, one section of the freeway was to be depressed while another portion was to be elevated. At this same time a tract was being developed west of Cambridge Street, which is the first through street east of Tustin Avenue. The engineers received permission from the Santa Ana Public Works Department to make a connection to this tract. The District issued a purchase order to Orange County Pipeline, the sewer contractor for the tract developer, to extend approximately sixty feet of sewer to the tract boundary. Later, as a part of Contract No. 7-4-2A (Vadnais, Contractor), an Encroachment Permit to cross the proposed Garden Grove Freeway was issued by the State Division of Highways to the District, and a physical connection was made between the stub-out from the Santa Ana tract to Fairway Drive in Orange. This connection serves the District No. 7 area north of the Garden Grove Freeway and west of the Newport Freeway. The sewage discharged into the Santa Ana system at this point does not return to the District's facilities until it reaches First Street, Santa Ana, east of the Santa Ana Freeway. It has been proposed by the engineers that Santa Ana's facilities handling this sewage be purchased as part of the Master Plan System of the District. ~ . -.~·"' . --~ -. Recommendations herein have been gone over in detail with the Executive Committee at its meeting Decembe r 1st and the report of the committee on this subject is enclosed herewi th . Suggested Resolution No . 65.201 attached to the formal agenda will put into effect these recommendations . As the Directors are aware, no salary or personnel changes we re made f or the current fiscal year at the time our Operating Budget wa s prepared. However, t he Boards, by including a reserve sum in the salary and wages budget , acknowledged that salary adjus t - me nts during the year would be necessary. The reason for delaying act ion on thes e mat te rs at budge t t ime wa s to avoid complications for the individual Directors be- c aus e of their similar duties in their respective Cities, Sanitary Districts and the Coun ty Government . The cause of these complica- tions is the fact that our budget, owing to the system of joint operation which we have, must be prepared well ahead of the other g overnmental agencies. As a matter of fact our Join t Operating Budget, including salaries and wages, is adopted in June of each year whereas most of the Cities and Counties do not adopt final personnel revisions and official budgets until the early part of August . The f ollowing recommendations for changes in our personnel setup ha ve been deve l oped as a joint staff effort after several months of considerable study and analysis . We have analyzed the salary schedules of the County Government and all of the major cities in the County and have attempted to bring our salaries to a comparable level with these other governmental agencies, wherever possible. We have accumulated a considerable volume of background data and information which, while summarized below , will be avail- able for inspection at the December 8th Board meeting . In connec- tion with our study of sal.a..ries of other governmental agencies we have employed the common procedure of established bench mark posi- tions for comparison. In our case these key positions are La.borer , Engineering Aide, and Secretary (office). A table of comparative salaries for these jobs is attached. Also attached is a four-page tabulation summarizing the recommended changes in our personnel setup. It will be noted that our positions have been, as in the past, grouped into two major categories , Operational Employees and Administrative Employees, with the former group being sub-classified as to function. Our studies show that practically every city and the County government have already granted a general salary increase for this year . On the other hand, the Sanitation Districts' last salary adjustment was made in December of 1964. In our analysis of these increases, it was noted that there was a distinct trend toward a blanket increase for most employees. It is important to note from this tabulation that although two new positions have been added and certain changes of titles and duties recommended, because of deletion of two posi - tions, there will be no over-all increase in the total number of positions (115). Summary of Recommendations Our recommendations fall into three separate categories and can be summarized as follows: (1) (2) (3) An over-all uniform one-range increase (5.5%) for all positions except one, with two positions recom- mended for a two-range increase with no change in title and four positions for a one and one-half range increase with also no change in title. A change in title and salary for four positions, as explained below, chiefly to re f lect the increasing responsibilities of these positions. No change for the three top positions of General Manager, Assistant General Manager and Secretary- Director of Finance. We expect to have prepared within the next ninety days recommendations affecting these positions and possibly on other personnel matters for the consideration of the Executive Committee and the Joint Boards. Explanation of Recommendations 1. General Adjustments in Salaries. Our anaylsis of our salary setup as compared with other local public agencies shows that at the present time our schedules are generally one range (5 .5%) or -2- more below the others in most categories, particularly in the labor - ing and secretarial (office) categories . Attached he ret o, as pointed out in t he foregoing is a tabulation showing our recommendations for adjustments in salary which basically are a one-range increase for all positions except one , the greater increases recommended for six positions with no change in title and three for varying increases with change in title, all as explained in the fol lowing section. 2. Positions Recommended for More than One Range Increases but No Change in Title . (a) Construction En ginee r. Th e salary range proposed for the Construction Engineer (52.5) is still somewhat less than paid b y state, county, and local agencies for Senior Engineer , which is a direct l y comparable titl e . As most of the Directors are aware, there is keen competition in re cruiting for engineering positions and an agency which does not pay at least as well as other agencies in the a rea, is chronically handic a pped by a s ho rtage of competent help . (b) Engineering Aide. Our analysis of the Engineering Aid e position as shown on the attached bench mark tabulation shows that this increase is definitely warranted and necessary to retain a qualified employee. The salary range propos ed for Engineering Aide (41) brings this position abreast of similar jobs in other agencies . (c) Administrative and Purchasing Officer . A one and one -half range increase is proposed for this position to reflect the increasing responsibilities of the job with the growth of the orgainization and the vo lume of purchasing and administrative matters to b e handled. (d) Secretary (office ) (3). These three positions are also recommended for a one and one-half range increase to bring their salaries to a somewhat comparable level with similar jobs e lsewhere as shown on the attached bench mark tabulation . 3 . Positions Recommended for More than One Range Increase and Change in Title. (a) Electrical and Mec hanical Supervisor. We are rec ommending that the title of this position be changed to Mainten - ance Superintendent with a salary range increase from 46 to 4H. Both the title change and the salary change are recommended to reflec t more accurately the increasing responsibilities of the j ob. See attached job description . (b) Accountant. We are recommending that the title of this position be changed to Assistant Director of Finance, and the -3- salary range increased from 43 to 47. (The immediate effect of this recommended change is only a two-range salary increase for the employee, in that it will require at least two years before the 5th step of this range can be attained.) The reason for this recommen- dation is that the duties and responsibilities of the job as they have developed in the past two years are much greater than originally conceived . The new title and salary range more nearly reflects the a lready assumed responsibilities of the job and the salary proposed is comparable to other agencies for similar work. See attached job description. (c) Purchasing Clerk. We are recommending that this position title be changed to Assistant Purchasing Officer and salary range increased from 40.5 to 42.5. Again, the reason for this recom- mendation is to more accurately reflect the existing duties of the job as it has developed in our organization. See attached job description. 4. New Positions. Only two altogether new positions are being recommended and they are both in the lower categories. Our stepped up volume of engineering detail requires the addition of one Draftsman position at range 35.5 and the increases in routine office work such as reproduction machine work requires the position of Office Aide which is proposed at $1.90 per hour. Actually, since two positions are being recommended for deletion (see attached tabu- lations), the addition of these two jobs will not result in a net increase in the number of our employees. 5. Miscellaneous Changes. (a) Consolidation of existing positions of Chief Control Center Operator and Chief Plant Operator to one position of Operations Engineer. Our careful study of our plant operating setup shows definitely that these two jobs can be consolidated into one with a net reduction of one position. We are proposing that the new position of Operations Engineer be therefore established at a salary range of 49,5, as opposed to range 44 and 47.5 of the two existing positions. See attached job description. (b) Change in title with no change in duty or salary other than the over-all proposed one range increase. We are pro- posing that the existing job of Maintenance Supervisor at range 44 be changed in title to Assistant Plant Maintenance Supervisor to more accurately reflect the existing duties of the job. See attached job description. Financing of Above Recommendations As previously stated, the Joint Boards budgeted funds ($23,500) for adjustment of salaries for the current fiscal year. -4- This s um , together with salary sav ings accumula t ed f r om un f illed positions, will be more than adequate to cover the abov e described proposed increases in salaries. The total cost of these changes will u e approximately $19,200 for the balance of' the fiscal year . Your Executive Committee met in the Wedne sday, December 1, 1965 at 3:00 p.m. Cornwell, Chairman, Harvey, Parks, Gruber Hirstein and Lambert. Districts' office on Present were Directors (for Stoddard), Meyers, Others present were Lee M. Nelson, General Manager, Paul G. Brown, Assistant General Manager and Fred A. Harper, Secretary and Director of Finance. Chairman Cornwell presided . The only item of business taken up was the December 1 Manager's Report entitled "Manager's Recommendations for Employee Salary Adjustments and Personnel Changes". A copy of this report is atta ched hereto. The report and each recommendation therein was read and considered item by item . Numerous questions were raised by the Committee members and discussed with the General Manager. It was noted by the Committee that the salary increases recommended in the Manager's Report fall into three general categories: 1 . An over all increase of one salary range for most employee positions. This increase was shown in the Mana g er's report to be justified on the basis of comparable data presented for the benchmark positions of Laborer, Engineering Aide and Secretary (office) and data on other positions. It was agreed this over all type of increase is necessary at this time to mainta in a competi - tLve recruitment position by the Districts. It was recogni z ed that since the staff of t h e Districts is quite small, the loss of any well trained employee, regardless of his position, can be of serious consequence and result in sev ere hampering of operations as well as actual monetary loss through training of new personnel. For these r e asons the Committee recommends this type of salary increase not altogether to maintain a cost of living parity, although this is important, but principally to maintain the existing excellent personnel efficiency b y remaining in a competitive position with other a g encies . 2. Increases of more than one range for six positions. In addition to the one range increase described under No. 1, the Manager's recommendations for additional salary increases for six existing positions were gone over in detail. On the basis of comparative salary data presented, it was agreed that the increases proposed are justified again on the basis of maintaining a competitive position by the Districts in the existing labor market. 3. Changes in title and increases of more than one range. As noted above, the Committee carefully studied all of the changes in this category and agrees that over and above the one range increase described under (1), certain positions, as noted in the attached report, have grown in responsibility and thus are entitled to reclassification and additional salary. After reviewing with the General Manager the duties of the employees in these positions and their qualifications, the Committee agreed that these changes proposed are thoroughly justified. The Committee also noted and agreed with the General Manager's recommendation that consideration of the salaries of the General Manager, Assistant General Manager and Secretary & Director of Finance be postponed until a later meeting. The General Manager reviewed for those in attendance, the Basic Accommodation Agreement dated December 14, 1960, between Districts Nos. 3 and 11 which was entered into to provide temporary s e werage service for a portion of District No. 3 by using District No. 11 facilities. At the time the agree- ment was executed, it was anticipated that within a period of five years, District No. 3 would have constructed its own facilities to serve this area of the District. This portion of the District has been developing rapidly and all the local sewerage facilities are designed to connect into the existing facilities of District No. 11. At the October 27th meeting of District No. 11, the engineers were directed to pre- pare an Engineer's Report outlining the immediate needs of District No. 11, with recommendations as to required facilities. Mr. Milo Keith of Lowry and Associates, engineers for Dis- trict No. 11, reviewed for the Committee members and the Directors of District No. 11 the suppl e mental s e werag e fac i lities n e eded in the immediate future to serve the northe rn p orti on of District No . 11 and the southwestern area of District No . 3 b eing s e rve d thr ough the District No. 11 sewer system. Mr. Keith sugg ested that since it is no t now e conomically feasible for District No. 3 to build facilit ies to serve the a r ea now being served by District No. 11, District No . 3 should consider the acquisition of permanent capacity rights in that p o rtion o f the District No. 11 system. Concurrently with this, to relieve the overloaded conditions in the northerly portio n of District No. 11, that District should: 1. Acquire capacity rights in District No. 3 1 s Mille r-Holder Trunk Sewer from approximately Slater Street south to Treatment Plant No . 2. 2. Construct a n e w pumping station in the vicinity of Go lden- west and Slater and other facilities necessary to discharge into the Miller-Holder Trunk Sew e r. Mr. Keith said that the e ng inee r's report now being pre - pared will includ e some alternate methods of relieving the District No. 11 system. However, he said it is quite apparent that District No. 3 should acquire permane nt capacity rights in the present Dis- trict No. 11 facilities and that District No . 11 should acquire in the very near future, at least t e mporary capacity rig h ts in the Mill e r-Holder Trunk Sewer from Slater south. Th e Engineer's Re port will develop cost figures wh ich will e nable the Directors of both Bo a rds to arrive at definite conclusions. BACKGROUND 0 No--------- December 8, 1965 SUBJECT: Acquisition of Existing sewer Line in Tustin Avenue North of 17th Street from the City of Santa Ana The only remaining work to be done that was described in the engineering report .. of November, 1961, as modified,. · is the construction or acquisition of a sewer line extending northerly from a point below 17th Street in Tustin Avenue approximately 300 feet northerly to its intersection with Fairhaven Avenue. The City of Santa Ana has a 12 inch sewer line in Tustin Avenue in the area described extending about 600 feet northerly of Santa Clara Avenue. This sewer was constructed.by the City of Santa Ana subsequent to the adoption of the engineering report and substantially after the passing of the bond issue approving the engineering report. Various requests to.the City of Santa Ana regarding ac- quisition of this sewer by the District have been made since it was constructed beginning back as .far as 1962. Each time the city manager asked for more time to consider the matter. 'Finally, at your direction, I wrote the City Council of the City of Santa Ana on October 5, 1965, formally requesting acquisition of the sewer line. After considerable delibera- tion and after I had appeared before the Council on November 15 and explained the matter at length, the City, upon recommendation of its manager, refused to sell this sewer line to· the District. LEGAL DUTIES OF THE DISTRICT By reason of the existing engineering report which became binding upon the District when the bonds were passed by the voters of the District,· it is the legal responsibility of the District to either acquire this line or build another line substantially paralleling this already existing facility. I haye discussed with the District engineers whether some modification could be made to the report which would provide substantially the same service to this area of the District. I was informed that nothing short of building a duplicate line in this area would be a reasonable modification of · the report. RECOMMENDATION In that it seems wasteful to build a new sewer paralleling an already existing sewer which sewer would be designed to serve that area which the existing sewer is now capable of serving, I believe an attempt should be made to acquire this sewer by eminent ·domain proceedings against the City of Santa Ana. While the law is not entirely clear on this subject, the basic premise ·of the power of a public agency to acquire property from another public agency is that the condemning agency must show that their use is a more necessary public use than that to which the property is already devoted. I believe that such a showing can be made · in this situation because the sewer as owned by the City of Santa Ana can be used only by that territory that is within the City's limits of the City of Santa Ana. If the sewer is acquired by the District, .those users of it new within the City of Santa Ana will not have any change in their existing service and additionally those people within the District not now in the City of Santa Ana may use the sewer without being required to annex to the City of Santa Ana. It is c~ear that if, for example, the City of Orange were seeking to acquire thi. s line for the purpose c£. serving its inhabitants it could not acquire it from the City of Santa Ana for this purpose because these would be essentially competing services and if Orange were allowed to acquire the line then it could exclude those portions of the City of Santa Ana now being serv·ea by the line. In the case of the Sanitation District acquiring the line, the existing properties served by the line will continue to be served and additional properties not now capable of using the line can acquire the right to use the line. 2. -~ ACTION REQUIRED If the Board desires to follow my recommendation, a resolution authorizing condemnation of the line as needed to comply with the engineering report will have to be passed by 2/3 of all of the members on the District's Board.
