CALIFORNIA MINUTES OF HEARING ON RESOLUTION OF INTENTION NO. ASSESSMENT DISTRICT NO. 4 October 30, 1963 2:00 o'clock p. m. The Secretary reported that this was the time and place fixed for the hearing .of protests or objections against the work or the District1 as described in Resolution of Intention No.63-145-71 in the matter of the construction of sani- tary sewers and appurtenant work in "ASSESSMENT DISTRICT NO. 4 11 , as des- cribed in said resolution. The Secretary also reported that affidavits in support of the publica- tion of t~e Resolution of Intention, the mailing of printed notices of the adoption of said resolution, and the posting of the Notice of Improvement, as required by law, had been made and are on file in the office of the Seqretary. The Chair- man then inquired of the Secretary if any written protests or objections against the work or the District had been filed with him in said matter. A new section is hereby added to Resolution No. 63-10 to read as follows: Section 13A: If, in the judgment of the General Manager or his designee, and except as provided hereinunder, work beyond the normal work day and/or work week provided in Resolution No. 762, is required of an employee paid on a monthly basis, such overtime ser- vice will be compensated for in equivalent time off with pay, to be taken not later than 90 days following the month in which the over- time service was performed; provided, however, that if the General Manager or his designee determines that the work load and schedule of an employee is such that all of such equivalent time off cannot be taken, the employee shall be paid for any overtime service at the same rate at which the employee was employed during the month the overtime service was performed. Any such overtime pay shall be separately itemized and paid on the payroll foI· the month in which the overtime service is performed and shall not exceed ten percent (10%) of the regular monthly pay of the employee on any payroll. After such payment is made, no further compensation, other than equivalent time off with pay as above provided, will be allowed for overtime service for the month for which such payment is made. For overtime service by any employee, the maximum amount of equivalent time off, with pay, shall be twelve {12) working days in any calendar year, unless otherwise ordered by the Boards. Except as provided hereinunder, any employee separating from the Districts' service who has performed overtime service and which overtime service has not been compensated for as provided above, shall be entitled to full pay at his regular rate for such overtime service. Any such overtime pay shall be separately itemized and paid in a lump sum on the payroll following separation. When separation is caused by the death of an employee, payment shall be made to the estate of ~ such employee, or in applicable cases, as provided by Section 630 of the Probate Code. Nothing in this section shall be interpreted as -4- preventing the General Manager from filling a position vacated by separation immediately following the last day actually worked by the separated employee. Provided, however, that no employee who occupies a position for which a salary exceeding that or Range 44, as hereinabove estab- lished, is provided, shall be paid either before or after separation for overtime service; and further provided that the General Manager shall cause to be kept a record or the accumulated overtime service of such employees and may grant equivalent time off with full pay at any time during employment to such employees upon application and for sufficient reason. Section 5. Each employee employed before the effective date of this resolution and assigned to a full time monthly position established in Section 2 hereof, shall be assigned the salary pro- vided for by the step rate to which such employee is entitled on the effective date of this resolution, under the provisions of, and the salary assignments authorized by prior resolutions, as amended. There shall be one or more common tanks to be used for either sludge gas or natural gas. The surge tank(s) may be mounted on the turbine base, or if gas starting is used the tank(s) shall be separately mounted. If gas starting is utilized the surge tanks shall be used also for storage of gas at an adequate pressure for starting duty with enough capacity for approximately seven starts. The storage capacity must be large enough in this case to bring the generator to synchronous speed so that the fuel gas com- pressor shall be powered by same. In the event fuel ~as start- ing is used the FUEL OIL SYSTEM shall be deleted." Item No . 15 is a resolution approving plans and specifications for Instrume ntation Installation for Jobs J -6 and P2 -5 (Job No . J5-l). This is basically an electrical cont r act to install central control equipment for two recently completed Plant 2 facilities, the new Ocean Outfall Pumpi n g Station and t he 40 MGD Primary Treatment Addition and Headworks . The estimated cost for this job is $27,000 . Item No. 16 is a r esolu tion approving p l ans and specifications for an additional primary clarifier at Plant No. 1. The estimated cost of this job is $232,000. I tem No. 17 is for paving at Plant No . 2. Most of this paving was orig inally included in Job s Nos. P2 -5 and J-6 but s ubs equ e ntly deleted by change order since it appea red preferable to do the paving all at once and, in addition, to patch up pavement and re-g rade other areas at the same time. The es timated cost of the paving is $61,500. No . 18 -ATTENDANCE AT WATER QUALITY CONFERENCE I N ANAHE I M: The Uni versity of California and the Regional Water Pollution Control Board are jointly spons oring a one~d ay wate r qua l ity conference at the Disneyland Hotel on October 17. This conference is attracting con- siderab le interest and a large at ten dance of water and waste disposal pe rsonnel is expected. The recommended motion appearing on the agenda authori zes reimbursement of the $5 registration fee to any Direc tor who wishes to attend and also authorizes the General Manager to des i gnate a maximum of six employees for at tendance and reimburs e - ment of fee. No. 19 -ADDENDUM NO . 1 TO P2 -7A: This addendum, attached to the agenda, pvovides five minor technica l changes to the specifications for the Turbine-Generator Set at Plant No . 2, bids for which will be received by the Board of Directors of District No. 1 on October 16. This particular contract was fully explained in last month's report . No. 20 -REPORT OF EXECUTIVE COMMITTEE: A member of the Executive Committee ~111 report on actions taken by the Committee at its September 26 meeting and at another meeting to be held just prior to the Joint Board meeting. One recommendation of the Committee is covered by Item No . 22 (below ) relating to personnel and sa l ary revisions. It is expected that the Committee will make a final recommendation on two other items which will be reported on at the Joint meeting . No. 2'l -PERSONNEL AND SALARY REVISIONS: Resolution 63-142, attached to the formal agenda, puts into effect recommendations arrived at at the September 26 meeting of the Executive Committee regarding salaries and positions for Joint Works and Administrative personnel. The recommended personnel revisions are fully covered in a separate report. Nos. 22, 23 and 24 -CLOSEOUT OF PLANT JOB NO. P2-5: The contractor on this job, Hoagland-Findlay Engineering Company, fully completed his work at the end of last month . Many of the Directors viewed this job when it was under construction last May and are aware of the work involved . It provides an additional 40 MGD of badly needed primary capacity at Plant No. 2 and a new headworks pumping station. Item No. 22 is Change Order No . 5 adding $2,399.46 to the contract for miscellaneous additional work done in the last month and as detailed in the formal change order attached to the agenda. Item No . 23 is Change Order No. 6 granting the contractor an extension of time of 60 days for reasons detailed in the formal change order. Item No. 24 is the customary resolution accepting the job as complete and authorizing filing of Notice of Completion. No . 25 -ACCEPTANCE OF PROPOSAL FOR FLOW MEASUREMENT TESTS: We are recommending employment of the Lynch Radiation Service to make accurate flow measurements in our incoming trunk sewers to the Plants in order to check out the calibration of our influent meters. The method involved is called the "Total Count· M"ethod" and was developed by the Standard Oil Company of California and licensed to the Lynch Radiation Service . It employs radioisotopes and we are satisfied that it provides a very accurate flow measurement. This firm has had e x tensive experience with this method in the past two years with the Bureau of Reclamation, University of California, the City of Los Angeles, Los Angeles County Sanitation Districts and various industries. The recommended motion, attached to the agenda, autho- rizes the firm's employment for this purpose in accordance with their proposal for a maximum cost of $3,000 . -2- No. 26 -CONSIDERATION OF REQUEST FROM FOUNTAIN VALLEY FOR PURCHASE OF PROPERTY: This item was held over from the September 11 meeting pending determination by the City of Fountain Valley as to whether approval could be obtained from regulatory authorities for construct- ion of a water reservoir on our Plant No. 1 property. We are informed that by the time of the meeting the determination will have been made and, if appropriate, further action on this matter will be recommended to the Directors at the meeting. No. 27 -PURCHASE OF BUILDING AT PLANT NO. 2: The owners of the minera l rights on 27 acres of property recently purchased by the Districts at Plant No. 2 are willing to sell to the Districts a very substantial warehouse building located on the property for the sum of $500. Since this appears to be a very reasonable price for a building which can be utilized for a number of purposes, we are recommending by means of the suggested motion appearing on the agenda that the transaction be approved. A minute order on this matter is necessary in order that the building may be removed from the tax rolls. District No. 1 No . 31 -REVISED ESTIMATE ON JOB Pl-12: The Directors of District No. 1 will recall that when bids were taken for this job the staff was directed to revise the estimated cost in view of an obvious ommission o f a portion of the work from the original estimate. A letter explaining the ommission and a corrected estimate is included for the Directors of District No. 1. No. 32 -AWARD OF PLANT JOB NO. Pl-12: Resolution No. 63-146-1, attached to the agenda, awards this job to R. W. McClellan and Sons of Costa Mesa for $28,240. The job consists of site improvements at Plant No. 1 including paving, a block wall and other work in the general vicinity of the new office building now under construction. District No. 6 No. 48 -CONSENT INSTRUMENT FOR FEDERAL GOVERNMENT: At the August , 1963 meeting of the Board, the execution of a quitclaim deed to Tartan Homes, Inc., et al, for certain interests in the former Army Air Base property was approved. We are now advised by the Federal authorities that it will be necessary to authorize execution of a consent instrument between the Federal Government and the District to consummate the transaction. The recommended resolution (No. 63-148-6), attached to the agenda, accomplishes this purpose. District No. 11 No. 52 -REPORT ON RELOCATION OF SEWER: At the September 17 adjourned meeting of the Board, the District's engineer was requested to submit a report on terms of an agreement with a property owner in connection with development of his property for subdivision purposes. This agreement would involve relocation of an existing force main from the -3- . ' property to the street and the payment to to be abandoned and other costs involved. report at the time of this writing but it submitted before the Board meeting. Item No. 56 is Change Order No. 3 adding $53.18 to·the contract for substitution of a grate instead of a regular manhole cover. Item No. 57 is Change Order No. 4, the customary adjustment of total contract price at the end of the job in accordance with unit bid prices of materials actually installed. This change order adds the sum of $31.00 to the contract. Item No. 58 is the customary closeout agreement barring further claims by the contractor and at the same time granting an additional 30 days for completion. Item No. 59 is the resolution accepting the job and authorizing filing of Notice of Completion. Nos. 60 through 64 -CLOSEOUT OF CONTRACT 7-3E: This job, consisting of subtrunks on La Colina Drive, Irvine Boulevard and Newport Avenue, has been completed by the contractor, AAA eonstruction Company. Item No. 60 is Change Order No. 1 (revised} which reduces the original change order price by $207.02 because of less extra work than anticipated. Item No. 61 is Change Order No. 2 providing an additional payment of $229.20 for extra work caused by utilities not shown on the original plans. Item No. 62 is the customary adjustment of total contract price at the end of the job in accordance with unit bid prices of materials actually installed. This change order deducts $4,910.50 from the contract. Items Nos. 63 and 64 are the customary closeout agreement and resolution accepting the job as complete. No. 65 -ACCEPTANCE OF EASEMENT: This is a formality recording acceptance of easement for a tract connecting sewer at no cost to the District. Nos. 66 and 67 -REIMBURSEMENT AGREEMENTS: Two reimbursement agree- ments for offsite sewers are being drawn up and it is expected that -4- they will be ready for authorization of acceptance. Item No. 66 is for an extension bo the existing Sycamore Avenue master plan trunk sewer. Item No. 67 is for a non-master plan offsite sewer in the vicinity of B Street and Mitchell Avenu~ west of Newport Avenue. Since this is a non-master plan line, the agreement provides for a reimbursement of connection fees for property subsequently using the line. No. 68 -REFUND OF CONNECTION CHARGE: At the last meeting of the Board the question of a refund to Beechwood Estates of $300 for an unused connection already paid was discussed and action postponed until this meeting. We are now recommending that this sum be refunded. No. 69 -ADJUSTMENT OF SALARY: The salary of our Construction Inspector is now established at Range 43, the same as our Plant Construction Inspector. Since we are recommending a general one- range raise for all Plant and Maintenance employees, the recommended resolution attached to the agenda has been prepared to grant an increase in salary to Range 44 to this District 7 position. However, if our recommendations are approve d by the Committee, it is believed the Committee wi ll desire to transmit this report and its attachment s to each Director together with the formal recom- mendati ons of the Committee. From time to time , we have discussed with the indi vidual Board members and made verba l reports at Board meetings concerning the phenomenal expansion of our treatment plant works and of our trunk sewer network. Wi th the exception of a few of the newer Directors, we believe the Board members, in general , are quite familiar with our growth problems. For this reason, we do not feel it appropriate to repeat the many statistics of our growth. However , to emphasize this point , I would like to repeat tha t the Districts, in July of this year, will be operational for only eight years but in that period our flow has increased approximately 600% and ou r capital investment, 400%. To our ~ knowledge, the above rate of growth cannot be approached by any comparable sewering agency in the United States in the last 100 years. But more important than history and statistics is the fact that we have reached maturity while still growing at the tender age of eight. Our long awaited and planned Control Center became fully functional on January 20. This accomplishment marks the most significant operational milestone in our brief career. Heretofore it has been a continual struggle to construct facilities fast enough to handle the increased flow. Although we will probably be in a continuous construction program for the next fifteen to twenty years, our main emphasis from now on should be improved operation so that our primary function of preventing pollution of the ocean can be more efficiently and better ac- complished. Recruitment and training of compe.tsent personnel has always been a problem and with the advent or the Control Center operation, we must direct our attention more to operational matters while not, of coures, neglecting our construction program. OPERATIONAL PERSONNEL Changes in Classification and SalaJ:7 The attached table entitled Operational Employees contains our recommendations for salary adjustments, reclassification and additional positions for our operating staff. A separate similar table is also appended for administrative employees. These tables also compare the proposed set-up with the existing situation. Under the respective groups as captioned in the table, an explanation for the proposed changes follows: -1- SUPERVISORY GROUP -No new positions are proposed to be added to this group but four changes of title, one 3-range increase, three 2-range increases and two 1-range increases are recommended. The change in titles are to define more clearly the actual responsi- bilities of the jobs. Also, it is very unlikely that we will ever be able to fill the Chief Plant Operator position (now Sanitary Engineer) with a qualified engineer who will be content to stay with us at this salary. Accordingly, the job will now be called Chief Plant Operator in order that a highly qualified and experienced man but without engineering registration can be employed. The 3-range increase is for the man who will be responsible for day to day functioning of our effluent and pre-chlorination facilities. This is a highly responsible job and lack of an experienced and reliable man can result in tremendous expense to the Districts, not to mention violation of standards established by the Water Pollution Control Board. The three positions recommended for 2-range increases are high level supervisory positions which, because of our plant ex- pansion and trunk sewer activities, are increasing in responsibility each month. The l~range increases are in keeping with our recom- mendation to adjust most employees salaries one range upward because of the lack of salary increase last year mentioned previously. CONSTRUCTION SUPERVISION AND INSPECTION -At the present time we have under contract over $2,600,000 in work in four separate contracts with another $2,000,000 job to commence this summer plus a new office building. We do all of the inspection and most of the plan and shop drawing approvals. We are not recommending any additional positions but the adding of a higher paid man (Con- -2-·· struction Inspector) and the deletion of a lower paid job (Assistant Construction Inspector). We are also recommending that our Construction Engineer be given a 3-range increase. The reason for the first change is that we need a highly experienced and qualified additional man who does not necessarily need to· be a registered engineer but should have enough engineering training and experience to check plans and shop drawings for our Construction Engineer and generally assist him in engineering computations. The reason for the 3-range increase for the Construction Engineer is that the present incumbent (Mr. Tremblay) has recently obtained his engineer- ing registration and with his past experience is eligible for the recommended salary range or more in a number of public agencies who are desperately in need of registered civil engineers. Because of Mr. Tremblay 1 s 18 months experience with us and since he has demonstrated that he is a very capable engineer, we would be in great difficulty if he took another job. FOREMAN GROUP -There are eseentially no changes in this group except for a 1-range increase tor our three Trunk Maintenance Fore- men in keeping with the concept of a general raise~for most employees. OPERATOR'S GROUP -This is the key group as related to the new Control Center operation mentioned above. We are recommending our former position of Plant Operator be now called Control Center Operator with a 1-step raise and one additional man added. These five men will man, on a 24-hour, 365 day basis, our new Control Center and will be the key men in the surveillance of the proper -3- functioning of both treatment plants and our fifteen outlying pumping stations. These men will not leave the Control Center un~ess for an emergency and will telephone instructionssto the men on the ground when instruments indicate operating difficulty at any point. These men have already been trained and are now manning this Control Center. The other changes are merely to shorten and simplify titles and to grant the recommended general 1-range increase. MAINTENANCE AND CONSTRUCTION GROUP -It is in this group that we are recommending most of our new positions. Because of the tremendous amount of new equipment which has recently been installed in the plants and the new pumping stations being put into operation, we find·ourselves very shorthanded and falling behind in mechanical maintenance. Therefore, we are recommending that three new positions, called Mechanic I, be added and four Laborer positions be added. It should be pointed out that both Mechanic I and Mechanic II are not necessarily automobile mechanics. As a matter of fact, of this group only two or three men work on maintenance of mobile equipment. The rest are equipment operators, stationary engine mechanics, welders, electricians, etc. To keep our classifications at a minimum, we like to group these men in the mechanic classification rather than give them specific titles. The new Mechanic I position is one grade above the Mechanic II and is for men of slightly higher skills. The ... present Instrument Repairman has been changed in title to Flow Meter Technician since this man will spend most of his time in supervising and keeping in proper working order our flow meters whose proper fUnctioning is vital to an accurate accounting of the individual Districts• financial contribution to the Joint works. -4- LABORATORY GROUP -Basically, no changes are recommended in this group except for a 1-range increase tor Laboratory Aide. It might appear that we are neglecting this group but we have made a careful analysis of their duties and salaries as against other public agencies and private industry and feel that no general salary increases are justifiable. SUMMARY OF PROPOSED CHANGES FOR OPERATING EMPLOYEES -From the attached table, it can be determined that our overall recom- mendations for this group show a total or eight additional positions (nine added and one deleted) from a total or 77 to 85. Ten title changes and reclassifications are recommended. Two classifications are recommended for a 3-range increase, three for a 2-range increase and fourteen for a 1-range increase. Overall, 69 operating employees would receive a salary adjustment. SHIFT DIFFERENTIAL -In addition to the above recommended changes, we are recommending that all employees required to work regularly on shifts other than the day shift be paid a differential of $2.00 for the 4:00 p.m. shift and $2.50 for the midnight shift. The reason for this recommendation is basically for the inconvenience to family life and routine for working other than during the day. This practice is quite common in.private industry and with Govern- mental agencies. Heretofore, we have considered that the employee's basic salary could be established at a sufficiently attractive figure that shift workers and their families would not be too dis- satisfied with the arrangement. However, psychologically, this theory does not work and we believe that, as industry and other agencies have discovered, it is almost imperative to pay a -5- differential for shift work to prevent dissatisfaction of employees and their families and to promote recruitment of shift workers. We have, under our proposed operational changes as described above, a total of 19 positions for regular shift workers. The recommended differential would cost the Districts approximately $550 per month or an average or about $29 per man per month. It is recommended that this differential be paid quarterly as a lump sum to continually remind the employee and his family that he is being given material recognition tor generally unpleasant hours of duty. ADMINISTRATIVE AND OFFICE PERSOmNEL As attached hereto, the table entitled Administrative Employees deta1ls,·1n tabular form, our recommendations for our office employees. For reasons stated in the next section, the three top positions are left blank for the Boards' determination. In general, our recommendations contemplate a 1-range increase for three of our secretarial pool with an accompanying change in title to Secretary and a 1-range increase for our Accountant position to keep it on a par with present County positions which our present employee (Mr. Sylvester) is eligible for. For the other office personnel, no increases are contemplated. However, the former classification of Records Clerk {part time) is recommended to be put on a permanent full time basis at approximately the same salary now received. One additional part time stenographer is also recommended to handle the peak loads of clerical work which occur from time to time. We also contemplate using one of these positions at times and as needed to assist in the increasing clerical work at the plant office. -6- MANAGEMENT POSITIONS I consider our three chief management positions to be General Manager, Assistant General Manager and Secretary and Director of Finance. Where information is readily available, the following tabulation compares salaries of comparable positions in the listed sewering agencies plus other comparable agencies and cities. As the Committee Members are aware, no salary or personnel changes were made for the present fiscal year at the time our budget was prepared but there was a tacit understanding at that time that recommendations in this connection would be forthcoming during the early part of the fiscal year. The reason for delaying action on these matters at budget time was to avoid complications for the individual Directors because of their similar duties in their respective Cities, Sanitary Districts and the County Government. The reason for these complications is that our budget, owing to the system of joint operations which we have, must be prepared well ahead of the other governmental agencies. As a matter of fact our Joint Operating Budget, including salaries and wages, is adopted in June of each year whereas most of the Cities and the Counties do not adopt final personnel revisions and official budgets until the early part of August. The following recommendations for changes in our personnel set- up have been developed as a joint staff effort between Mr. Brown, Mr. Harper, Mr. Galloway and myself after several months of con- siderable study and analysis. We have analyzed the salary schedules of the County Government and all of the major cities in the County and have attempted in these recommendations to bring our salaries and personnel practices to a comparable level with these other governmental agencies, whenever possible. We have accumulated a considerable volume of background data and information which, while summarized below, will be available for inspection in detail at the September 26 meeting. As the Directors are also aware practically every City and the County Government granted a general salary increase for this fiscal year, while the Sanitation Districts have not as yet. In our analysis of these increases, it was noted that there was a distinct trend towards .a :.blanket ilhcrease· ·for ·all emp:_toyees approximating 5 to 6<f; with certain supervisory personnel being given increases up to 15% and more. OVERTIME PAY We are recommending that Resolution No. 762 (Conditions of Employment), adopted in 1960, be amended by deleting provisions with respect to overtime pay and added to our existing resolution relating to positions and salaries. In addition to shifting overtime provisions from one resolution to another~ we are recommending cer- tain changes in connection with overtime pay, the necessity for which have been demonstrated since overtime pay provision was first made in 1960. These recommendations are summarized briefly as follows: 1. That an employee who cannot be allowed compensatory time off be paid up to 10% of his normal salary on a straight overtime basis for the same month in which he is paid his regular salary. Under the present system, a complicated bookkeeping arrangement is necessary since it provides that the overtime cannot be paid in cash until 30 days following the month in which it was earned. The l°" limitation is retained as a matter of mental discipline to the super- visors since overtime pay in any organization without limitation can easily become subject to abuse of "taking the easy way out" of scheduling of overtime work for employees required to be called out at night or on weekends. 2. That overtime pay be not paid in cash tor all employees over a certain salary (we are recommending the cutoff point be Range 45 and above -$641 to $797). At the present time all employees with the exception of Mr. Brown, Mr. Galloway and myself are entitled to overtime cash· pay although, in practice, our supervisory personnel never request such pay. In lieu or overtime pay for such super- visory personnel, we are recommending that their overtime be accumulated on the books and allowed to be taken off as compensatory time in the case or protracted illness or other severe emergencies up to 12 working days per year without Board approval with provision that the Boards can grant additional compensatory time off with pay for these employees by formal action. NEW POSITIONS AND SALARY INCREASES 1. Summary and Recommenda.tions Recommendations in this connection are summed up as follows: a. Add two new operational employees. b. Increase the salary of each monthly employee one range with tha exception of six supervisory positions which are recommended for two-range inc~ea~es. -2- ,-. c. No specific recommendation for top management personnel. For the Directors• guidance, data on comparable positions in the County is attached hereto. d. The cost or these changes is anticipated to be covered by existing and future salary savings throughout the year. 2. Operating Personnel Changes a. New Positions It is to be expected that because or our continued rate of expansion or approximately 15% per year, new operational positions must be added from time to time. As a minimum for this t1me1 we are recommending two new positions as follows: 1 -Electrical Foreman, Range 42 1 -Engineering Aide, Range 37 It has become apparent that our Plant and pumping station expansion has created a severe overload on our existing electrical personnel. The only supervisory position we have in this increasingly important category is that of ~lectr1cal and Mechanical Supervisor. A new man is needed to direct the electrical crew under the direction of the supervisor, paralleling an existing position of Shop Foreman tor directing the internal combustion equipment maintenance. Continued and accelerated construction and expansion activities at our Plants has disclosed another immediate deficiency in our engineering and inspection group. Required is an engineeringly trained individual, not of professional level, to relieve our one registered Construction Engineer of sub-professional work such as detailed checking or shop drawings for construction work, preparation or record drawings and construction plans for force account work and minor plant jobs not normally handled by our consulting engineers. This man would also be qualified for routine surveying and thus free our present registered engineer for strictly professional work, making better utilization of' his training and experience. A duties statement for each of these positions will be prepared and will be available for inspection. b. Salary Increases As stated in the transmittal, in keeping with practically all other public agencies we are reconunending that a one- range step (aµprox1mately 5-1/~) increase be granted to all -3- operating employees with the exception of the following five positions for which we are recommending a two-range increase: Superintendent of Operations, Construction Engineer, Plant Maintenance Supervisor, Electrical and Mechanical super- visor and Shop Foreman. 3. Administrative Personnel a. New Positions No new positions appear to be required at this time. or are recoxmnended. However, with the always increasing amount of records and paper work, we cannot guarantee that this status quo will exist too long into the future. b. Salary Increases We are recommending a straight one-range increase for all Administrative employees now employed on the step plani with the exception of the Administrative & Purchasing Officer position for which a two-range increase is reconnnended. In keeping with customary practice, we are making no specific recommendations for the top management positions or General Manager, Assistant General Manager and Secretary- Director of Finance, leaving the recommendation for salaries for these positions to be originated by the Committee for action by the Joint Boards. As mentioned above, data on comparable positions in the County is attached hereto. FINANCING OF ABOVE RECOMMENDATIONS We suggest that the above recommended changes be made effect- ive October 1, 1963. If these or similar recommendations are adopted, the question will naturally arise as to whether our 1963-64 budget will acconnnodate the increased cost of the recommended new positions and salary increases. The Directors will recall that at the time our salary budget was adopted in June of this year, it was understood that no reserve for salary adjustments would be shown as such but that when such adjustments were made, their financing would be handled out of Unappropriated Reserve Funds in the individual Districts' budgets, if necessary. We estimate that the total cost of the above recommended new positions and salaries increases.for the remaining nine months of this fiscal year will be approximately $50,000 (8%), at most, more than originally budgeted, if all new positions are immediately filled and all existing positions continuously filled, which never is the case. Our Director of Finance has estimated that we have -4- already accumulated in the neighborhood or $17,000 in salary savings for the first quarter due to unfilled positions caused by normal turnover and difficulty in recruitment. It is expected that this situation will prevail for the balance of the year and sufficient savings accumulated to pay for the additional $50,000 without re- course to the Unappropriated Reserve Funds. Suggested Resolution 63 -142 , attached to the formal agenda, will put into effect these recommendations, i f adopted. As the Directors are aware, no salary or personne l chan ges were made for the present fiscal year at the time our budge t was prepared but there was a tacit understanding at that time that recommendations in this connection would be forthcoming during the early part of the fiscal year . The reason for delaying action on these matters at budget t i me was to avoid complications for the individual Directors because of their sum.ilar duties in their respec tive Cities, Sanitary Di stric t s and the County Government. The reason for these complications is that our budget, owing to the system of joint ope r ations which we have , must be prepared we ll ahead of the other governmental agenc ies. As a matter of fac t our Joint Operating Budget , including salaries and wages, is adop ted in June of each year whereas most of the Cities and the Counties do not adopt final personnel revisions and official budge ts until the early part of Au gust . The following recommendations for changes in our personnel setup have been developed as a joint staff effort b etween Mr . Brown, Mr. Harper, Mr. Galloway and myself after several months of considerable study and analysis. We have analyzed the salary schedules of the County Government and al l of the major cities in the County and have attempted in t hese recommendat ions to bring our salaries and personnel p r actices to a comparable level wi th these other gove rnme ntal a genci es, whenever possible. We have ac cumulate d a conside rable volume o f background data and information which, wh ile summarized below, will be available for inspection at t h e October 9 Board meeting . As the Directors are also aware practically every City and the County Go vernment granted a ge neral salary increase for this f is cal yea r , while the Sanitation Districts have not as yet . In our analy sis of these i n cre as es , it wa s noted that there was a di stin c t trend towards a blanket increase f o r a ll employees approximating 5 to f% with certain supervisory personne l being g iven increases u p to 1 5% and more . '• OVERTIME PAY We are recommending that Resolution No. 762 (Conditions of Employm e nt), adopted in 1960, be amended by deleting provisions with respect to overtime pay and added to our existing resolution relating to positions and salaries. In addition to shifting overtime provisions from one resolution to another, we are recommending cer- tain changes in connection with overtime pay, the necessity for wh ich have been demonstrated since overtime pay provision was first made in 1960. These recommendations are summarized briefly as follows: 1. That an employee who cannot be allowed compensatory time off be paid up to 10% of his normal salary on a straight overtime basis for the same month in which he is paid his regular salary. Under the present system, a complicated bookkeeping arrangement is necessary since it provides that the overtime cannot be paid in cash until 30 days following the month in which it was earned. The 10% limitation is retained as a matter of mental discipline to the super- visors since overtime pay in any organization without limitation can easily become subject to abuse of "taking the easy way out" of scheduling of overtime work for emp loyees required to be called out at night or on weekends. 2. That ove rtime pay be not paid in cash for all employees over a certain salary (we are recommending the cutoff point be Ran ge 45 and above -$641 to $797). At the present time all employees with the exception of Mr. Brown, Mr. Galloway and myself are entitled to overtime cash pay although, in practice, our supervisory personnel never request such pay. In lieu of overtime pay for such super- visory personnel, we are recommending that their overtime be accumulated on the books and allowed to be taken off as compensatory time in the case of protracted illnes s or other severe emergencies up to 12 working days per year without Board approval with provision that the Boards can grant additional compensatory time off with pay for these employees by formal action. NEW POSITI ONS AND SALARY INCREASES 1. Summary and Recommendations Recommendations in this connection are summed up as follows: a. Add tw o new operational employees. b. Increase the salary of e ach monthly employee one range with the exception o f six supervisory positions which are recommended for two -range increases. -2- • c. Recommended salaries herein for top management personnel were established by the Executive Committee at the September 26 meeting without recommendation from myself. For the Directors' guidance, data on comparable positions in the County is attached hereto. New fositions It is to be expected that because of our continued rate of expansion of approximately 15% per year, new operational positions must be added from time to time. As a minimum for this time, we are recommending two new positions as follows: 1 -Electrical Foreman , Range 42 1 -Engineering Aide, Range 37 It has become apparent that our Plant and pumping station expansion has created a severe overload on our existing electrical personnel. The only supervisory position we have in this increasingly important category is that of Electrical and Mechanical Supervisor. A new man is needed to direct the electrical crew under the direction of the supervisor, paralleling an existing position of Shop Foreman for directing the internal combustion equipment maintenance. Continued and accelerated construction and expansion activities at our Plants has disclosed another immediate deficiency in our engineering and inspection group. A new section is hereby added to Resolution No. 63-10 to read as follows: Section 13A: If, in the judgment of the General Manager or his designee, and except as provided hereinunder, work beyond the ""-". normal work day and/or work week provided in Resolution No. 762, is required of an employee paid on a monthly basis, such overtime ser- vice will be compensated for in equivalent time off with pay, to be taken not later than 90 days following the month in which the over- time service was performed; provided, however, that if the General Manager or his designee determines that the work load and schedule of an employee is such that all of such equivalent time off cannot be taken, the employee shall be paid for any overtime service at the same rate at which the employee was employed during the month the overtime service was performed. Any such overtime pay shall be separately itemized and paid on the payroll rot· the month in which the overtime service is performed and shall not exceed ten percent (10%) of the regular monthly pay of the employee on any payroll. After such payment is made, no further compensation, other than equivalent time off with pay as above provided, will be allowed for overtime service for the month for which such payment is made. For overtime service by any employee, the maximum amount of equivalent time off, with pay, shall be twelve (12) working days in any calendar year, unless otherwise ordered by the Boards. Except as provided hereinunder, any employee separating from the Districts• service who has performed overtime service and which overtime service has not been compensated for as provided above, shall be entitled to full pay at his regular rate for such overtime service. Any such overtime pay shall be separately itemized and paid in a lump sum on the payroll following separation. When separation is caused by the death of an employee, payment shall be made to the estate of sµch employee, or in applicable cases, as provided by Section 630 of the Probate Code. Nothing in this section shall be interpreted as -4- preventing the General Manager from filling a position vacated by separation immediately following the last day actually worked by the separated employee. Provided, however, that no employee who occupies a position for which a salary exceeding that of Range 44, as hereinabove estab- lished, is provided, shall be paid either before or after separation for overtime service; and further provided that the General Manager shall cause to be kept a record of the accumulated overtime service of such employees and may grant equivalent time off with full pay at any time during employment to such employees upon application and for sufficient reason. Section 5. Each employee employed before the effective date of this resolution and assigned to a full time monthly position established in Section 2 hereof, shall be assigned the salary pro- vided for by the step rate to which such employee is entitled on the effective date of this resolution, under the provisions of, and the salary assignments authorized by prior resolutions, as amended. Section 6. Sections 3 and 4 of Resolution No. 762, Sections 1, 2, 3, and the first paragraph of Section 8 of Resolution No. 63-10, and all other resolutions and motions or portions thereof in conflict herewith are hereby rescinded and made of no further effect. Section 7. This resolution shall become effective October 1, 1963. -5- JOINT OWNERSHIP, OPERATION AND CONSTRUCTION AGREEMENT THIS AGREEMENT made and entered into this 8th day of October 1958, by and between the COUNTY SANITATIONDISTRICTS OF ORANGE COUNTY, CALIFORNIA, DISTRICTS NUMBERED 1, 2, J, 5, 6, 7 and 11, each being a separate public corporation, duly organized and existing under the County Sanitation District Act and each sometimes hereinafter ~eferred to as 1, 2, 3, 5, 6, 7 and 11. WHEREAS, each of the Districts, parties hereto, has been operating sewage treatment and disposal facilities jointly under the terms and provisions of a certain agreement dated December 12, 19.51, entitled "Joint Construction and Operation Agreement"; and, WHEREAS, each of said Districts owns an undivided and different interest in the various units and facilities consti- tuting the joint treatment and disposal facilities of the County Sanitation Districts, which are hereinafter called ';Joint Treatment and Disposal Facilities" and which are defined and described as all the jointly owned trunk sewers, real property, improvements to real property, treatment plant facilities, personal property and all sewerage facilities lying in, on Dr upon.any of the territory generally bounded by Ellis Avenue on ·the north, the channel of the Santa Ana River on the east, the· Pacific Ocean on the south and Bouchard Street extended south- ' erly to the Pacific Ocean on the west, and-including in addition thereto the .?,OOO ft. ocean outfall sewer extending into the. Pacific Ocean near· the mouth of the Santa Ana River; and, WHEREAS, the present ownership interests of the various Districts do not reflect the reaso~able requirements of .... the various Districts and do not serve as an equitable basis for the charging or m.q.in-tena.r:ine •. ope%»ation and IlP"' c-0nstruct.i.on ccst;s and expenditures; and, -1- 1 · WHEREAS, it is believed that a more equitable basis for continued joint ownership, operation and construction can be agreed upon and wil l serve the best interests of each District and the public in general: NOW, THEREFORE, I T IS MUTUA LLY AGREED BY AND BETWEEN EACH OF THE DISTRICTS, PARTIES HERETO, AS FOLLOWS: Section 1 . That County Sanitation District No . 1 of Orange County, California, is hereby made and appo inted agent for each of the Distr i cts, part i es hereto, for the purpose of contracting for new construction, operating and maintaining the joint treatment and disposal facilities and operating and main- taining the joint adm inistrative organization, and the granting of easement s, licenses and permits over, on, under or upon the territory and property of the joint treatment and disposal facilities; provided, however, that any agreement or contract to expend or any expend iture of money in excess of the sum of $1,000 .00 shall be done at the direction of or with the approval of each of the Districts, parties hereto (i.e., by motion or resolution authorizing, approving or ratifying). That County Sanitation District No. 1 shall perform such other duties as agent as may be directed by the Districts, parties hereto . Section 2 . That al l the County Sanitation Districts, parties hereto , shall have a joint administrative organization and off ice and shall have the same Chief Engineer and/or General Manager, Secretary and General Counsel; that said -- officers shall be appo i nted and serve at the pleasure of all the Districts, parties hereto, acting in conjunction with each - other; that such persons shall be appointed and serve for such time and for the compensation fixed by the Boards of Directors of the seven County Sanitation Districts, parties hereto; that other necessary or proper agents, servants, employees, attorneys, -2 - ....,,,1· accountants, laborers$ or others may be employed when authorized by the Boards of Directors of said seven County Sanitation Districts, ~hich shall fix their compensation and terms or employment. Section 3. That each County Sanitation District party hereto, shall from time to time transfer so much of its funds into the Sanitation District ~oint operating fund as may be necessary; that the Sanitation District joint operating fund shall be used to pay all administrative expenses incurred in the existence of the County Sanitation Districts, parties to this agreement, together with all costs of operations arising from the treatment and disposal of sewage and industrial wastes, not including new or additional construction as dis- tinguished from maintenance costs of jointly owned facilities. That each District shall be charged and shall pay the charges in direct proportion to the annual gallonage flows from each District -into the jointly owned treatment and disposal facilities. That said charges shall be computed periodically~ not more frequently than monthly nor less frequently than annually. That those Districts, parties to this agreement, but not discharging sewage or industrial wastes into the joint treatment and disposal facilities shall be charged a flat amount each month to defray the expenses jointly incurred on their behalf. That each year, not later than the regular meeting in June of the Districts, parties to this agreement, the General Manager or Chief Engineer shall recommend to the Districts the amount which is to be fairly charged to Jauch Districts as do not discharge sewage or industrial wastes into the joint works; and that when the amount is approved by the Districts discharging sewage and industrial wastes and the District to be charged, this amount shall be charged until -3- i • such time as an adjustment is recommended by the General Manager or the Chief Engineer or any District involved. That said charges may be fixed by resolution of all the Districts discharging sewage and industrial wastes into the joint treat- ment and disposal facilities and the District to be charged, and shall commence with the sum of $275000 per month f.or Diatrict No. io That tne terms "maintenance" and "operation" as used herein shall mean . the repair-a and upkeep made .. necessary by ordinary use and operation of the facilities, including all tools and operating equipment, materials and supplies, the wages aud salaries of employees engaged in 01., connected with the operation or the joint treatment and disposal facilities, and the costs and expenses, includi~g s~la~ies~ of the joint administrattve organization, but not i~1clud:ing any construction costs. That for the pu:!:'p\°'JSe of adjusting the ownership interests of the Districts, 9arties hareto, and the various component properties comprising the joint treatment and disposal facilities as hereinabove defined, it is agreed that each Dist-:rict shai.1 own the undivided percent of the whole of said joint treatment and disposal fac1l~t1es indicated after its name and shall pay or receive over a period ar not to exceed five years the amounts of money indicated in Schedule "A" attached hereto and made a part hereof_, and that said amounts remaining unpaid from time to t:J.me shall bear interest at the rate or three percent per annumo That annually, not later than June 30 of each calendar year commencing with the year 1959, there ehall be an adjustment of ownership interests in the whole of the joint treatment and disposal facilities between each of the Districts~ parties hereto, which shall prevail for the next ensuing fiscal -4- i . year. That said ownership interests shall be adjusted so that all sewage and industrial wastes originating within the Dis- tricts, parties hereto, may be treated and disposed of by the jointly owned treatment and disposal facilities. That the necessary percentage of each of the Districts, parties hereto, o~nership shall be calculated according to the mathematical average of said flows and assessed valuations for the three years immediately preceding the first day of July in each year, and that as each year elapses, that year's figure shall be added and the figures for the year oldest in time shall be dropped from the calculations. That with reference to Dis- trict No. 7, which has no flows, assessed valuation shall be the basis of determining its percentage of ownership interest until flows from said District have been measured for 12 months preceding the date of June 30 in any year. That after determining the necessary annual ownership percentage of each of the Districts, parties hereto, said percentage shall be applied against the total capital investment in the joint treatment and disposal facilities as determined on June 30 of the calendar year, to establish the ownership equity re- quired by each respective District. That payments or credits between the respective Districts necessary to adjust to the so established ownership equity required by each District shall be determined annually on June 30 of the calendar year. That each District shall pay or receive over a period of not to exceed five years from date of such establishment of ownership equity, any payment or credit so determined and that any said payments remaining unpaid shall bear interest at the rate of three percent per annum. Section 5. That in order to provide adequate sewerage facilities to adequately treat and dispose of sewage and industrial wastes arising within the Districts., parties hereto, it is contemplated that new construction within the -5- i . territory 1n which the treatment and disposal facilities are located will be required from time to tirnee That when such new construction is requlred and approved by each of the Districts, parties hereto, each District shall contribute its proportionate share of the costs thereof in accordance with the ownership interest of each District as of the date of the award of any such contract for construetiono That the payments required to be made for this new construction shall be made promptly out of the capital outlay rev&lving fund to which each District shall contribute its proportionate share of the total monies required. That the term "construction" shall mean the con- struction of any new facilities within the territory comprising the joint treatment and disposal facilities and shall include reconstruction which shall include the replacement or re- building of any of the facilities of the joint treatment and disposal facilities whether said replacement or rebuilding is made necessary by wear, obsolescence, accident or damage or destruction by flood, storm, earthquakes or other public calamity or act of God. Section 6. That to effectuate a fair and equitable distribution of the costs or maintenance and operation of the joint treatment and disposal facilities or parts thereof, meters shall be placed on the sewer mains emptying into the joint treatment and disposal facilities, which meters shall measure the discharge of sewage or effluent into said joint treatment and disposal facilities, and shall be considered control meters. That where more than one County Sanitation District discharges sewage or effluent into a sewer main owned by a County Sanitation District or County Sanitation Districts, at a point or points on such sewer main above its point of discharge into said joint treatment and disposal facilities~ -6- such County Sanitation District or Districts shall cause meters to be installed oq such branch sewer lines, whioh meters shall determir.e the flow of sewage or effluent into such sewer mains jointly usedo Such meters shall be read ei th€r weekly or monthly, or more frequently, if ad"1isable, and the readings shall be reported to the joint administrative office. That where the sum total of said reading for the meters on such branch mains ditfers from the readings of the control meter, such readir.gs shall be increased or diminished p:aoporticnately to conform to ths ree..dings of the control meters. That ~nder direction of the Chief Engineer or the General Manager, the strength of any and all sewage and in- d~strial wastes may be determined as often as may be necessary by employees of the joint administrative organization. Section 7. That each District, party hereto, shall have the perpetual right to use all the joint treatment and disposal facilities which are required to adequately treat and dispose or all sewage and industrial wastes arising within the terr1to!'y of said District. That none ot the Districts, par- ties hereto, shall in any way grant, encumber, limit or re- strict its interest or o~mership in any part of the said joint treatment and disposal facilities or seek to partition the sa~e or have any part thereof set apart in severalty or use said p3rt tcr any purpose other than the disposal of sewage and industrial wa~tes without the prior written consent of the other Districts, parties hereto. Sectic~ 8. That any fertilizer or other substance arising out of th'71 operation of the joint treatment and dis- posal facilities shall be the properties or the County San- itation Districts, parties hereto, and may be sold for the best obtainable price, such sale to be made by the Chief Engineer or General Manager, and the proceeds thereof shall be divided and apportioned among the parties hereto in the same proportion as the payments of maintenence and operation costs which are charged against each District. That said money is to be apportioned among and paid to said County Sanitation Districts on or before the fifteenth day of the month following the month in which said payments are received. That no District shall permit or knowingly countenance the use of the Joint treatment and disposal facilities or any par·ty t~ereof tor the disposal ot sewage, effluent or industrial wastes originating outside of its territoria1 limits, e;~cept upon conditions agreed upon and consented to by each of the County Sanitation Districts, parties hereto. Provided, however, that, should the said arbitrators be unable to obtain a majority 'V'Ote-~on· any issue presented to it, than said arbitrators voting in favor of making a finding on such issue shall designate a disinterested person to act as an ar- b1 trator, and the arbitrators voting against making such a finding shall designate a disinterested person to act as an arbitrator, and the persons so designated shall designate a disinterested person to act as the third arbitrator, .and the three persons so selected shall constitute a Board of Arbitra- tion to act in place of and have the powers of the Board of Arbitration composed or members of the respective Boards of Directors, and the findings approved by a vote of majority of the Board of three arbitrators shall be binding and con- clusive upon all parties hereto. Section 9. That this agreement shall continue in effect so long as it shall be to the interest and advantage of the Districts, parties hereto, to maintain such joint ad- ministrative organization and to operate a joint treatment and disposal facility. That if at any time it should cease to be to the interest and advantage of any District, party hereto, to continue as a party to this agreement and its Board or Directors shall so find and declare by resolution adopted by a two-thirds majority or the total number of Directors or such District, it may withdraw herefrom and teminate its obligations hereunder after one year's notice in writing to the other parties hereto or its intention to do so. That such with- drawal of a District shall become effective only at the end or the fiscal year next after the aforesaid one year's notice ·or intention to ~1thdraw and shall not be effective unless such -10- '"'-11 withdrawing District shall have fully and completely dis- charged all of its debts and obligations to any other District, party hereto, or the joint administrative organization 1 for which it shall become or has become liable up to the date of its withdrawal; provided, however, that should any District withdraw herefrom, this agreement shall continue in effect thereafter as to the remaining parties thereto in like manner as if said District so withdrawing had never been a party to said agreement; provided further, that any District so with- drawing from the joint administrative organization shall not · be entitled to be reimbursed for any contributions previously made by it directly or indirectly to the State Employees Retirement System of the State of California pursuant to the provisions of this agreement~ Section 10.
