AWARDING CONTRACT FOR CONTRACT NO. 7-2A, 7-3C
and 7-3D SUB-TRUNKS
A RESOLUTION OF THE BOARD OF DIRECTORS OF COUNTY
SANITATION DISTRICT NO. 7 OF ORANGE COUNTY, CALI-
FORNIA, AWARDING CONTRACT FOR CONSTRUCTION OF
CONTRACT NO. 7-2A, 7-3C & 7-3D SUB-TRUNKS
The Board of Directors of County Sanitation District No. 7 of
Orange County, California
DOES HEREBY RESOLVE., DETERMINE AND ORDER:
Section 1. That the recommendation of the Engineers and the
General Manager, the tabulation of bids, and the proposal, are
hereby received and ordered filed; and
Section 2. That contract for construction of CONTRACT NO. 7-2A,
7-3C, 7-3D SUB-TRUNKS is hereby awarded to BOSKO CONSTRUCTION, Con-
tractor, in the total amount of $ 3 / l, , f l.-8'", o o , , in accordance
with the bid of said Contractor, which bid is hereby determined to
be the lowest and best bid therefor received on January 18, 1963;
and
Section 3. That the Chairman and the Secretary of the Board
of Directors of County Sanitation District No. 7 are hereby autho-
rized and directed to enter into and sign a contract with said
Contractor for the work to be done and the material to be furnished
for said work pursuant to the specifications and contract documents
therefor; and
Section 4. That all other bids received for said work are
hereby rejected, and that all certified checks or cashier's checks
submitted as bid bonds, be returned to the unsuccessful bidders.

DISTRICT NO. 7
MOVED:
That in the construction or Contract No. 7-2A, 7-3C & 7-3D
Sub-Trunks, a standard charge to the property owner of $150.00 is
hereby established for a 4" house lateral constructed by the
Distr1ct1 s Contractor; and,
That a standard charge of $8.oo per foot ($225.00 minimum)
is hereby established for a 6" commercial lateral constructed by
the District's Contractor; and,
That funds received from these charges shall be deposited
into the District's Facilities Revolving Fund and shall be disbursed
from time to time in accordance with the terms of the construction
agreements as construction progress payments.

A RESOLUTION OF THE BOARD OF DIRECTORS OF COUNTY
SANITATION DISTRICT NO. 7 OF ORANGE COUNTY) CALIF-
ORNIA, INTERPRETING A PORTION OF ORDINANCE NO. 705
The Board or Directors of County Sanitation District
No. 7 of Orange County, California
DOES HEREBY RESOLVE, DETERMINE AND ORDER:
Section 1. That in those situations where the resi-
dents or property owners in County Sanitation District
No, 7 of Orange County have paid for direct connection
construction under District supervision during the trunk
and subtrunk sewer construction, Sections (d) and (e) or
Article 4 of Ordinance No, 705 shall be interpreted to
mean: "that when such residents or property owners make
the actual sewer connection their direct connection charge
shall be $200.00, where Section (d) is applicable and
$225,00 where Section (e) is applicable," by reason of
the fact that there will be no further street opening or
repairs occasioned when the actual sewer connection is
made, in that this portion of the work will have been
done at the time of the trunk or subtrunk sewer construe-
tion.

Ordinance No. 707
An Ordinance Repealing Ordinance No. 703 entitled, "An
Ordinance Providing for the Creation and Establishment of the
Residents Advisory Committee for County Sanitation District No. 7
of Orange County, California".
The Board of Directors of County Sanitation District
No. 7 or Orange County, California does ordain as follows:
WHEREAS, an expression of opinion representative of the
residents and areas within County Sanitation District No. 7 relative
to the policy for the construction of sewerage facilities within
the District and related matters has been obtained:
NOW THEREFORE, the Board of Directors of County Sanita-
tion District No. 7 of Orange County, California, acting in the
best public interests, does ordain as follows:
ARTICLE I
Ordinance No. 703 entitled "An Ordinance Providing for
the Creation and Establishment of the Residents Advisory Committee
for County Sanitation District No. 7 of Orange County, California"
is hereby repealed and made of no further effect.
ARTICLE II
The Chairman of the Board or Directors of County Sanita-
tion District No. 7 of Orange County, California, shall sigi1 this
ordinance and the Secretary of the District shall attest thereto
and certify to the passage or this ordinance and shall cause the
same to be published once in THE TUSTIN NEWS, a weekly newspaper
of general circulation printed, published and circulated in County
Sanitation District No. 7 of Orange County, California, within
fifteen days after the date of the passage of this ordinance by

the Board of Directors; and said ordinance sha11 take effect thirty
(30) days after it has been passed and adopted by the Board or
Directors or said County Sanitation District No. 7.
PASSED AND ADOPrED by the Board or Directors of County
Sanitation District No. 7 or Orange County, California, at an
adjourned regular meeting on the 30th day of January, 1963.

#6 The Secr etar y r ead the letter dated January 30, 1963,
from Boyle & If;)wry, District Engineers, with reference to the bid
proposals received for Contract No. 7-2A, 3D & 3D, recommending t hat
the Contract be awarded to Bosko Construction on their appar ent low
bid for the pro ject; however, the Engineer s noted a d i scr epancy in
t he bid on Item #6 where t he written unit price was Seven and No
100/Dollars and the figures were $7.50. The total bid submitted was
for $322,745 .00 but if the written unit price on Item #6 was u sed
t he total wou ld be $316,928.00.
The General Manager submitted to the Directors his
written recommendation regarding this di s crepancy . It was the
Genera l Manager's opinion that the discrepancy resulted from a
copying error f~ the Contractor and it ~learly the Contr actor's
intent to bid item #6 at $7 .50. ~
The Gener al Counsel for t he Di strict submitted a legal opinion
..n--:> stati ng that it ~ not possi bl e for t he Board of Directors to accept
t he figures written and disregard t he wor ds written in the b id be-
cause the proposal form contains the following sentence in the
schedule of prices, "In the case of a di scr epancy between words and
figures, the words shall prevail11 • The General Counsel advi sed the Board
that this is not the type of informality which the Board has reserved

the right to waive in t he bidd~r's proposal.
The Chair then recognized Mr . Stanton Belland, Counsel for
Bosko Construction Company, apparent low bidder, who presented the
I Contractor's position in t fe matter.
Following a le thy discussion regarding the discrepancy
between the words and fig es on Item #6 of the bidder's proposal,
it was moved, seconded dul y carried:
That the co r ecommendations from the
District 's Eng i neers, n eral Manager, and Gener al Counsel, be
received and ordered f\:-ed; and on the adv~ of the Gener al Counsel
..t.a;a;t; the contract be prepared showing the unit price on Item #6 as
Seven and No/100 Dollars and the total contract price as $316,928.00.
FURTHER MOVED : That there exists an ~n6nest dispute between the
Contractor and the District as to wh7ther the bid on Item 6 was
Seven Dollars as written or $7.50 ;is appeared in figures on the
proposal. This question may bjtdetermined by legal a ction without
prejudice to the Contractor a¢d in full recognition of h i s contention.

DO HEREBY RESOLVE, DETERMINE AND ORDER:
Section 1. That the specifications and contract documents
for construction of 12 KV SWITCHING CENTER, JOB NO. J-8A, have
this day been submitted to the Boards of Directors or County
Sanitation Districts Nos. 1, 2, 3, 5, 6, 7 and 11 of Orange
County, California by John A. Carollo, Consulting Engineers; and
Section 2. That said specifications and contract docu-
ments are hereby approved, adopted and ordered filed 1n the
office of the Secretary; and
Section 3. That the Secretary is hereby authorized and
directed to advertise for bids for said work pursuant to the
provisions of the Health and Safety Code of the State or Calif-
ornia; and
Section 4. That said bids will be received in the office
ot the Secretary of the Districts until February 1, 1963 at
2:30 p.m., at which time they will be publicly opened and read;
and
Section 5. That County Sanitation District No. l of
Orange County, California, acting as agent for itself and County
Sanitation Districts Nos. 2, 3, 5, 6, 7 and 11 of Orange County,
California, is hereby authorized and directed to receive bids
and to award contract tor said work in the manner prescribed by

dated December 14, 1962 for foundation investigation work
for the proposed additions to Plant 1 at Ellis Avenue and
Santa Ana River, Fountain Valley, California {Job No. Pl-9)
be and is hereby approved, accepted and ordered filed; and
that the General ~anager be authorized to direct LeRoy
Crandall and Associates to proceed with the work described
in said proposal; and
That payment of a basic sum of $2,200.00 is hereby
authorized to be made to LeRoy Crandall and Associates from
the Capital Outlay Revolving Fund for said investigation
and formal report. This basic sum is subject to an addi-
tional charge, in the event it is necessary to drill addi-
tional explorations or deepen the planned borings, of $5.00
per lineal foot using truck-mounted rotary bucket-type
drilling equipment; and $6.00 per lineal root using geo-
physical-type drilling equipment.

INC,, Contractor, for ENGINE-GENERATOR NO, 11 PLANT NO, 1, JOB NO,
Pl-8 of County Sanitation Districts Nos. 1, 2, 3, 5, 6, 7 and 11 of
Orange County, California, and the tabulation or bids submitted for
said work, and the proposal are hereby received and ordered filed;
and
Section 2. That contract for said Job No. Pl-8 is hereby
awarded to West and Wiggs, Inc., Contractor, in the total amount of
$89,899.00 in accordance with the terms or their bid and the prices

Section 1. That the certain Agreement dated January 9, 1963,
between County Sanitation District No. 11 of Orange County, California
and the Talbert Drainage District, providing for temporary rental
by said Drainage District of a portion of an inactive sewer line
in Banning Avenue, is hereby approved and accepted; and
Section 2. That the Chairman and the Secretary of the
District are hereby authorized and directed to execute said Agree-
ment on behalf of the District.

Under paragraph (c), FUEL SYSTEM 1 add new paragraph
to read as follows:
"The equipment to be supplied under the contract
does not include the scrubber and compressor for
use wrth sewage gas. This equipment will be
supplied and mounted by others at a later date
outside of the building. However, necessary gas
piping to connect to these units shall be extended
two feet beyond the south building wall and capped.
Under this contract, a scrubber for the natural gas
supply ~ shall be furnished~ installed and
mounted by the contractoro"

Certain modifications were made to the Plans after the re-
duced half-size drawings were printed. Full scale drawings which
the Contractor may wish to order per Section 3-1 of the Speci-
fications reflect these modifications •.
The Contractor will note the following changes to the half-
s cale drawings:
Sheet 3: The 2-inch V drain in the manhole detail at centerline
of Navy Way has been eliminated and a brick bulkhead
has been added, and brick plugs may be used to seal
off the 18-inch and 24-inch Vitrified Clay Pipes.
The casing detail reference has been changed to read
1122.
Sheet 5: The casing detail reference has been changed to read
1122.
Sheet 7: The casing detail reference has been changed to read
7122 and an elevation of 84.0 ± is posted on the top of
the casing at the down stream end and an elevation of
85.6~ has been posted on the bottom of the footing for
the bridge.
Sheet 8: The casing detail reference has been changed to read
1122.
Sheet 14: The casing detail reference has been changed to read
7122.
Sheet 16: The grade from Station O +00 to 13 + 50 has been re-
vised to S•O.Dl56 and the invert elevation of the man-
hole at O + 00 has been revised to 164*17.
Sheet 22: Detail 2 -The Vitrified Clay Pipe stopper has been
replaced by a brick plug and the dimension from the
manhole cover to the bottom of the 24-inch rings has
been changed to 2' l".
Detail 6 -The note "House lateral shall be bedded the
same as mainline sewer" has been added.

Consideration of motion re: That in accordance with
Section 5-11, page 12 of the contract (plans and speci-
fications) entitled "SUSPENSION OF THE CONTRACT", in
the opinion of the District, the Contractor has failed
to prosecute the work with the diligence and force
specified and intended in and by the terms of the con-
tract; and the General Manager for the District is hereby
authorized and directed at his discretion to serve
written notice on the Contractor for Contract No. 7-3
(Lemon Heights Trunk Sewer), Staler, Inc., stating that
said Contractor will be suspended from the contract if
it has not, within five days after receipt of said
notice, completed the contract to the satisfaction of
the District's engineers

PARTIAL NOTES ON DIST. 7 BOARD MEETING, JAN. t• 1962 4:00 pm
11-A Arthur Guy, attorney for the contractor said he was not
fully informed as to details as claimed by Boye & Lowry -have not re-
ceived letter of January 4, therefore not able to debate the deficiencies
with the engineers. Before any action is taken by the Board regarding
· the letter of Jan. 4, it would appear that they should have an opportunity
to check the claims against the actual factual deficiencies on the premises
Doney------Will the deficiencies be corrected as mentioned in the
December 13th letter?
Guy----they are being corrected
Stare--claims details are being magnified out of all proportion
Dmney---how many have been completed?
Stare---Work has been done on five or six
Doney--Satisfactory work?
Stare---! assume so. It seems that it is impossible to satisfy the
District at this time
Nelson---They claim they have not received sufficient notice; many
of these items have been dragging for two or three months.
Nisson--recommended action be taken as per Agenda Item 11-A--carried
~ Five days written notice; shall correct the deficiencies within
five days --notice will go out Monday. Carried
.J&.._/Stastation 31.51, manhole not called for in the specs; have not
received any written authorization for this manhole; can not proceed until
we receive written consent to do so.
Harper stated the engineers have written a letter stating the
Change Order is in order for the manhole--Board has not acted on the
change order as yet
Nissen ---requested this be authorized by the staff; said it was cheaper
to put in the manhole; paper work apparently has not been done
12-A---there will be a regular board meeting next Wednesday; no
reP.ort_~ --~ecei ved from engineers as yet; if anything has to be done, let it
go thru then--continued to next Wednesday.
lZ. Raymond c. Martin concerned over sewering facilities for
certain property. Lowry stated if a manhole is availagle in the north-
east corner of the Catholic school property, this would be a point where
Martin could connect for the 24 unit plan.
Lowry also stated sewer not under design -will bore under the Santa
Ana Freeway -may delay this borning -haven't lost any time by this
change --it will be two months before the plans can be submitted to the
~ Board -probably 45 days from date of award before date of beginning of
c.onstruction.
Nelson recommended letters be received and filed and referred to
the staff and engineers -right of way pr~blems have to be work out
--carried
Guy -request for consent to assign {Nisson read letter) the balance
of the West Trun Sewer to Van Diest Bros., Inc. from Station 39=50
Nisson gave a resume of this contract -assign that portion of
the contract which has not been done other than the remedial work neces-
sary
Van Diest stated he is willing to accept and sign a statement that the
District has not delayed the contract performance to date. Will furnish
bonds on labor and materials for work which they are to do. Nissan
, recommended the Board authorize this p read resolution. Van Diest signed
statement so adoption of the resolution was in order ----carried
Request for re-assignment received and filed
Regarding the remaining portion of 7-5-2, Nisson recommended the

position in the matter, and following further discussion by

vided in ~ection 8-2 of the General Provisions portion of the
